All three people in car were ordered to get out of car after the police officer suspected illegal drugs were in car. Police officer searched the car and found crystal meth in the trunk of the car. Man was arrested along with the other two people.

A Motion to Adjudication Guilt was filed against client and he was re-arrested and held in jail without bond.

  • FACTS: Woman had a ranch with over 20 donkeys on it. Sheriff deputies came to her property and took away all over her donkeys, and they accused her of not providing necessary food and water for the donkeys.

  • FACTS: Police pulled client's car over at night after seeing car swerve and cross over into another traffic lane illegally. Client admitted to drinking alcohol, his breath smelt of alcohol, and he spoke with a slurred speech. He failed the roadside field sobriety tests. And he failed the breath test by blowing a 0.16 (twice the legal limit). Police arrested him for misdemeanor DWI.

  • FACTS: Man was on felony probation for 5 years for falsifying written doctor's prescriptions. While on probation, he got arrested in Seguin for two new felonies and later tested positive for using marijuana. The District Attorney filed a Motion to Revoke Probation and Adjudicate Guilt. Client was re-arrested and brought back to court.

  • FACTS: Ex-husband got into argument with his ex-wife. He then called the police to say ex-wife drove away in her car with their infant child. He claimed child was not buckled in child safety seat when she drove away. One year later client ex-wife indicted on felony charge.

  • FACTS: District Attorney's Office filed a Motion to Revoke Probation and Adjudicate Guilt on client only one month after he was placed on probation. The DA Office alleged client was not reporting and not giving correct information about his home address and place of employment.

State vs S.F. (Bandera County):

  • CHARGE: Motion to Revoke Probation (DWI 2 nd)
  • FACTS: Man was placed on probation for 1 year after pleading guilty to DWI 2 nd charge. Probation department later filed a Motion to Revoke (MTR) his probation in order to send him to jail. The probation department alleged that while on probation he assaulted and choked his wife, he failed to report, and he failed to pay probation fees.
  • FACING: $4,000 fine and 1 year in jail.
  • RESULT: DISMISSAL OF MTR and PROBATION RE-INSTATED

State vs R.H. (Kerr County):

  • CHARGE: Criminal Mischief and Unauthorized Use of Motor Vehicle
  • FACTS: Married couple hired a contractor to remodel their home. They paid him thousands of dollars. He did very little and poor work. He then walked off job. Couple sued him in small claims court. He retaliated by filing false claims with police that husband drove and damaged the contractor's company truck. The contractor also committed insurance fraud in process. However, police did little investigation and arrested husband on felony charges of driving and damaging the contractor's truck.

  • CHARGE: Evading Arrest with a Motor Vehicle
  • FACTS: Police accused client of trying to evade and escape as they turned on their flashing lights and tried to stop his car. He eventually safely stopped his car and was arrested.

  • CHARGES: Aggravated Kidnapping, Sexual Assault, Assault Bodily Injury
  • FACTS: Man's ex-wife accused him of kidnapping her and their children at knife-point and threatening to take them out of country. She also told police he hit her and sexually assaulted her in his pickup truck. He was indicted on all three felonies and case went to jury trial.
  • FACING: $10,000 fine and 99 years or life in prison.
  • RESULT: NOT GUILTY ON BOTH AGGRAVATED CHARGES

  • CHARGE: Driving While Intoxicated (DWI)
  • FACTS: Police came to scene of one-car accident and spoke to driver of car. Police officer believed driver might be intoxicated because his speech was slurred and he smelt of alcohol. Driver refused the field sobriety tests and breath test. Police arrested him for DWI.
  • FACING: $2,000 fine and 6 months in jail.
  • RESULT: DWI DISMISSED and REDUCED to LESSER CHARGE

State vs J.O. (Guadalupe County):

  • CHARGE: Assault causing Bodily Injury – Family Violence
  • FACTS: Client got into argument with his girlfriend after coming home from work. His girlfriend called the police almost 24 hours after the argument. She accused client of holding her down and slapping her in the face. Client was charged with misdemeanor assault.
